Public offer
This document is an official public proposal (offer) to conclude a contract for the provision of services in accordance with Art. 633, 641 of the Civil Code of Ukraine and has full legal force.
1. General provisions
1.1. This offer is an official proposal of LLC «BAISK» (hereinafter - the Contractor) to any individual or legal entity (hereinafter - the Customer) to conclude a contract for the provision of services on the terms specified in this document.
1.2. The fact of placing an order on the website baisk.com.ua and/or payment for services in any form is considered acceptance (acceptance) of this offer.
1.3. From the moment of acceptance of the offer, an agreement is considered concluded between the Contractor and the Customer on the terms set out below.
2. Subject of the contract
2.1. The Contractor undertakes to provide the Customer with services, the list and characteristics of which are specified on the Contractor's website, and the Customer - to accept and pay for them.
2.2. Specific terms, cost and conditions of provision of services are determined when placing an order and agreed upon by the parties.
3. Rights and obligations of the parties
The Contractor undertakes to:
- provide services of appropriate quality in accordance with the terms of the contract;
- inform the Customer about changes in the procedure for providing services;
- maintain the confidentiality of information received from the Customer.
The Customer undertakes to:
- provide the Contractor with reliable data necessary to fulfill its obligations;
- pay for services in a timely manner in accordance with the terms of the contract;
- not transfer rights and obligations under this contract to third parties without the written consent of the Contractor.
4. Cost of services and payment procedure
4.1. The cost of services is determined in accordance with the price list posted on the Contractor's website, or is agreed upon individually.
4.2. Payment is made in the national currency of Ukraine in a non-cash or other agreed form.
4.3. The Customer is considered to have fulfilled the payment obligation from the moment the funds are credited to the Contractor's account.
5. Liability of the parties
5.1. The parties are liable for improper or non-fulfillment of their obligations in accordance with the current legislation of Ukraine.
5.2. The Contractor is not responsible for:
- incorrect data by the Customer;
- failures in the operation of the Internet or payment systems that are not dependent on the Contractor.
6. Force majeure
6.1. The parties are exempt from liability for partial or complete failure to fulfill obligations in the event of force majeure circumstances confirmed by the Chamber of Commerce and Industry of Ukraine.
7. Term of the Agreement
7.1. This Agreement shall enter into force from the moment of publication on the Contractor's website and shall be valid until its withdrawal.
7.2. The Contractor has the right to make changes to the terms of the offer. Changes shall enter into force from the moment of their publication on the website.
8. Other conditions
8.1. All disputes arising between the parties shall be resolved through negotiations, and in the event of failure to reach an agreement - in court in accordance with the legislation of Ukraine.
8.2. In all other matters not provided for by the agreement, the parties shall be guided by the norms of the current legislation of Ukraine.
